The negative testimony of witnesses, that they did not hear a bell or signal, who at the same time testify that they paid no attention to signals or that they did not hear other sounds and signals admittedly given within their hearing, must be accounted for either by lack of recollection or entire failure of attention to sounds. Such negative testimony should not be held to overcome positive testimony that signals were given and heard.
